Shahanee Cattery Contract
PURCHASER AGREES TO THE FOLLOWING TERMS OF SALE:
NO CASH REFUNDS!
Under NO circumstances will this cat/kitten, nor it’s offspring ever be sold, leased, or given to any pet shop, research laboratory or similar facility.
If purchaser decides, for any reason, not to keep this cat or kitten, it will be returned to seller and purchaser will receive no cash refund. The cat or kitten will become the property of the seller. If purchaser wants to give this cat or kitten to someone else, the seller must approve of the new owner and the new owner must sign a similar agreement.
Adequate indoor sanitary housing will be provided for this cat/kitten at all times, and this cat/kitten WILL NOT be allowed to roam outdoors freely.
If, at any time, this cat/kitten is found to be neglected, abused, or in ill health for an unreasonable length of time, purchaser will surrender said cat/kitten to seller unconditionally with no refund of purchase price/fees or reimbursement for costs incurred while cat/kitten was in purchaser‘s possession. Purchaser is responsible for any and all legal fees and costs incurred in the enforcement of this contract.
This cat or kitten has been purchased for: PET or SHOW
If this cat/kitten is purchased as a PET, purchaser agrees to NEUTER or SPAY this cat/kitten between four (4) months and ten (10) months of age and guarantees that it WILL NOT be used for stud or breeding. Seller requests notification when this procedure is done.
Purchaser has three (3) working days to have blood test on this cat or kitten for Feline Leukemia virus. After three (3) days, seller has no responsibility to purchaser. The purchaser accepts full responsibility for any veterinary costs incurred with this cat or kitten.
Seller makes no guarantees as to the health or show quality of this cat or kitten except as follows: Will test negative for Feline Leukemia.
Purchaser agrees never to have this cat or kitten declawed.
FUTURE CHANGES TO THIS AGREEMENT - We may change the terms and conditions of this Agreement/Contract from time to time. Notices will be considered given and effective on the date posted on http://ShahaneeCattery.com. Such changes will become binding on you on the date they are posted to our website and no further notice by us is required upon your continued ownership of your cat/kitten regardless if it was purchased as a pet, breeder, or show quality cat/kitten. The Agreement as and when posted supersedes all previously agreed to written terms of agreement, including, without limitation, any terms included with the cat/kitten. It also supersedes any written terms provided to the purchaser in connection with kittens produced by a breeder male or female, including, without limitation, any written terms included with the cat/kitten regardless if purchased as pet, breed or show quality cat or kitten.
ALTERING AGREEMENT
Purchaser agrees to have this kitten spayed/neutered by 10 months of age. If this is an adult cat over the age of 10 months and the cat is not already spayed or neutered, the purchaser agrees to have this cat spayed or neutered within 30 days following the date of purchase. In addition, purchaser agrees and guarantees that this cat/kitten WILL NEVER be used for stud or breeding! Registration papers will be issued to buyer only after proof of spay/neuter of this cat/kitten has been provided!
Purchaser agrees to provide the breeder written proof that the cat/kitten has been spayed or neutered within the above time frame. Such proof must be in the form of a letter or certificate signed by a licensed veterinarian clearly stating that a spay/neuter operation has been performed, a description and name of the cat/kitten and the date it was performed by the veterinarian. Breeder shall provide the purchaser with a copy of the pedigree and registration slip/certificate and refund of altering deposit (*if any) ONLY after receipt of proof that the cat has been spayed/neutered.
If, at the end of the time frame listed above, seller receives no proof of altering, the purchaser will pay the Seller an automatic fee of $750.00 and will not at any time be entitled to the registration paper for this cat or kitten. This fee applies if the cat is lost or given to another person without written permission of the seller. Should the purchaser be found to be using this cat/kitten for breeding, seller will have the right to have this cat/kitten plus all kittens produced from this cat/kitten returned to her at no charge. Should there be a medical reason as to why this cat/kitten should not be altered, the purchaser should contact the seller with a written statement from a veterinarian stating the reason. The seller will not be responsible for any veterinarian expenses.
It is mutually understood that failure to comply with any provision of this contract may detrimentally affect the reputation of the breeder and Shahanee Cattery.
Breach of contract penalty is $750.00 per item. In addition, the buyer shall be liable for any court costs and related charges including lawyer's fees associated with the seller enforcing the terms of this contract.
Any legal action that may arise under the terms of this contract will be brought in the county/city of the seller's residence.
All parties must initial changes or additions to this agreement.
I have read and understand all terms included in this contract and altering agreement. I accept this contract and altering agreement, and agree to abide by the terms thereof.
